When you break the law, you are a criminal. Laws cannot be rewritten to justify actions already taken.

Here's a hypothetical: If I'm clocked doing 90 miles an hour on the freeway I get a speeding ticket. If the state legislature raises the speed limit to 90 next year, can I ask for my ticket money back? No.

G.O.P. Senators Say Accord Is Set on Wiretapping

WASHINGTON, March 7 — Moving to tamp down Democratic calls for an investigation of the administration's domestic eavesdropping program, Republicans on the Senate Intelligence Committee said Tuesday that they had reached agreement with the White House on proposed bills to impose new oversight but allow wiretapping without warrants for up to 45 days.

Of course, the fact that they had to amend the law to allow the administration's actions is pretty much proof that, under existing laws, their actions are illegal. Good thing I've stopped expecting morality, courage or even basic logic from anyone with an "R" in front of their names.
